What determines the procedure to be followed?

The procedure for public tendering is determined based on the needs and criteria of the contracting authority. The cost of the contract is particularly important and will be estimated over its total duration and value. Several elements are taken into account, including mandatory and permitted options, all extensions of the contract, and the maximum value estimated for all contracts during the duration of a framework agreement or dynamic purchasing system. The value is determined at the start of the procedure and determines the rules that apply throughout the contract, to the extent that these rules depend on the estimated value of the contract (Articles 6 and 7 of the Royal Decree of 18 April 2017 on public procurement in the classical sectors).
